Just curious, we have friends an older couple both disabled, who are currently in foreclosure, they have yet to be evicted and have an attorney working for them, but I want to know if they are evicted how is that handled can't seem to find anything on the web to answer my question.... anyone have any input...they reside in the State of Ohio...are rule different for every state?

Question about breaking apartment lease?

My husband lost his job a little over 2 months ago, due to this we couldn't afford our town house monthly rent. We had to break our lease with the apartment complex. We had 3 months left on our 1 year lease. We advised the property manager that we were unable to make rent for the month of June at the end of May. We advise if of our move out date, she stated that we were phenomenal tenants and she hated to see us go but she understood the reasoning and she would forfeit our security for the last months rent. On moving day, she came to our home. She stated that because of protocol, she had to file an eviction notice with the court. They only give you a ten day grace period before they file an eviction on you. She also stated that the court date was the 22nd and if we could pay her half the rent she would dismiss the eviction. Since we already forfeited our security deposit and paid for last months rent when we moved in, we didn't see any reason to pay again. When we told her that she stated that because we have children, it could be considered child neglect if we get "evicted." I told her that our children were in Florida with their grandparents for the summer and that when they returned they would have a place to live. She left at that point. When my husband turned in the keys, she once again asked for the money and a forwarding address. We didn't give her any money but gave her a forwarding address which was our PO box. She told him that she needed a physical address to serve papers to and if he didn't give that to her she would be forced to serve myself at work. So to avoid the embarrassment of that we should pay her half the rent to dismiss the eviction notice. I understand protocol but it seems as if she is using scare tactics to get more $$$ from us. We have already left, wouldn't the judge dismiss the eviction notice based on that? I know we are on the hook for breaking our lease but she told us we would work out an arrangement on that. Any help would be great. I live in NC by the way.

Landlord dragging his feet on providing a written 1 yr lease for us to sign?

This is in the State of Michigan. My boyfriend and I moved into an apartment earlier this year in a 3 apartment triplex, and it was a month to month oral lease. Our landlord occupied the largest of the 3 apartments in the same house, and he recently moved back to Indiana, and we moved into his old apartment upon the agreement that we would sign a 1 year lease. We have been excellent tenants and have cause zero issues (no late payments, no property damage, etc). It is going on a month now and we have asked our landlord (who now lives in Indiana 2 hrs away) several times to provide the written lease for us to sign. He keeps saying he'll email it so we can print it out, look it over, sign it, make a copy of it, and send him the original while we keep the copy. Several phone call reminders just get us more excuses ("I'll do it when I go to work today", or "I'll go to my parents house and email it", etc). What has us alarmed is that he mentioned that he was thinking of selling the triplex, and he verbally assured us that he wouldn't screw us over by putting us in the position of not having a lease in case he does sell the triplex, which would allow the new owner to evict us or raise our rent, etc. I have written him a note requesting that he mail us the lease within a week, otherwise we will have to do what is right for us and rent from someone else who will provide the security of a lease. He has been a good landlord up until this point as well, but still it takes all of 5 minutes to print out the lease, and mail it to us (or email it even, which he still hasn't done). I don't think we can legally force him to provide a lease to us, and frankly that is the last thing I'd want to do especially since we really like this apartment and we've even made several repairs & painted the interior. We even mow the lawn which is the landlord's responsibility, but we do it just so he doesn't have to drive 2 hrs one way just to do it. I don't understand why he keeps stalling, please help with any good advice. I don't want to assume he's a bad landlord, but what can we do to get the lease? Also, if I remember correctly, he owns the house jointly with his father. Should I contact his father even though we pay rent to & consider his son our landlord? My sons father is taking me to court for SOLE CUSTODY!!?

I am 22 years old (full time mother) to a 2 and half year old beautiful boy. I am on welfare and have a nice apartment (not housing) and I also get support from my mother she has been buying me groceries for 2 and half years since my sons father refuses to pay child support. My sons father is 23 years old and has A lot of money, he has a lawyer and I don't and HE FILED COURT ON ME! We both have shared custody since we are both on the birth certificate. I am a stay at home mom, I have been taking care of my child and so has he but he started paying me $198 a month for about 5 months because my social worker demanded it. in October my sons father put my son in daycare Without My Consent!!! and stopped paying me child support all of a sudden!! I went to my social worker and they gave me a paper to show me how much he owes me in child support including the times hes missed and including INTEREST! My sons father makes me have him on the weekends now but I personally think he is doing this because his girlfirend (That he has cheated on me with when I was 7 and half months pregnant) Keeps telling him to take me to court and get SOLE custody and the court papers say he wants me to have supervised visits as if I'm some crack head or something (I DO NOT DO DRUGS) I am a good mother and take care of my son better then my sons father (his sisters and his girlfirned take care of my son and pick him up from day care since my sons father works 9-5 Job) when my son is with me he gets my FULL attention I am a young single beautiful mother and live on my own and make sure there is breakfast lunch and dinner on the table for my son at all times, I bath him at all times he is with me and take him with me everywhere i go when he is with me. I have court on Thursday at 11AM (June 30th) he lied and said i have no food in my fridge, and says my house is always dirty (I had the police investigate my house and said they have never seen a place so clean and nice since i keep my place well kept and they seen i had food in the fridge!) He says my hallway stinks of marijuana (witch is true) but only because my neighbors are pot heads and they are getting evicted they are moving next month my landlord found out they are selling drugs in the building so she evicted them! CLEARY my sons father is doing everything he can to lie on me just to win, wont it show he is trying to take my child from me because he clearly does not want to pay child support and he says he is takin me to court because I have no MONEY!!! Obviously not I only get enough to pay my rent and my mother provides the groceries since he refusees to pay child support but instead Pays the daycare teacher 800 DOLLARS a month! to do my job !! So about a month ago I noticed some spots growing on my carpet, and I complained to my landlord because it freaked me out. She got pissed but fixed it. depends what school if its like university of Arizona or mizzou than you have Absolutely chance you have to be really good to cheer for a big school if its a Junior college and you take tumbling 3 times a week and work really really hard maybe for a just ok college but it take many years to train for Cheer leading took me about 2 years just to get a backhandspring but now im working on tucks and i almost have em by myself and it took me like half a year to get a tuck. so train really hard and dont give up Good luck

Evicted tenant wishes to visit friends?

Moving boyfriend out?

OKAY! , Every since well two years ago i have trying out for sports and things. With friends we would try out for volleyball , track , softball, ex. you name it we tried it. My mom's friend who I called Aunt for my whole life, has a down on his lucky son who's wife I met while help caring for my so called aunt. When I was 5 I found it hard to spell or read, and he helped me by beating me and making me sit in a corner for hours with a book. Am I taking good care of my betta fish?

I love my betta fish! He is a male and is beatiful and cheers me up all the time! Everytime I come to see him he will swim around like craz and flap his gills and try and talk to my by opening his mouth i giggle my nose on his tank and he does the same thing! Today i was watching some videos about how Walmart is so cruel to the bettas and that made me question whther im taking good care of my fish or not. First of all he is always down or up in kis aquarium and doesnt move alot but if i come closer or if he seems me coming then he gets crazy and happy!! Second i put some seashells on his tank and usually it gets moldy and green but 2 days after i clean it and he is fine! And im worried his space is too small he has room to swim lots of it! I have been renting for 3 years and have always paid the rent. But I never got any notices of rent increases nor any communication whatsoever from the landlord (though the lease does state when and how much the rent increases should have taken effect during the past 3 years). Now my question is should I bring attention to the landlord of my past omissions or error in not paying the rent increases over the years and make amends or can I ignore it since he hadn't asked for the increases? And if I ignore the lease and he realizes this, does he have grounds to evict me? Is not taking the initiative myself and paying the rent increases a breach of the lease agreement?

If my landlord sends me an eviction notice to get out in 30 days. Do I still pay rent until I move out?

Okay so my landlord sent me an eviction notice. She wanted me to get out in 30 days. I am still not out but she would have to bring it to court to legally evict me. Correct? Am I required to still pay her rent until I leave? Also instead of her evicting us through the courts she decided to get an order of protection against me so I have to get out, Is that illegal to do that? For her to get a restraining order to force me out instead of just going to court to evict me? She was making a restraining order for harrassment. SHOULD I STAY, OR SHOULD I GO?

Ok, so I have been with my boyfriend for about 5 years. We met in Ohio and after about a year or dating he moved in with me. He has a 4 year old son with someone else. We lived together for a year and then split up and he stayed in Ohio and I moved back to New York. We decided to get back together and chose to move to Atlanta. I worked mad overtime to get us an apartment in Atlanta and brought him down and we were there 6 months before he started galavanting off to California to try and get some contacts...he is an aspiring music producer....and he had a friend already living there. He would go, stay two weeks and come back. This went on for about 2 months before I had a breakdown and ended up in the hospital. I lost my job once I got out of the hospital, and his friend offered to put us up out in California until we could get on our feet. So I chose to come out to California...no job waiting, no prospects, didn't know anyone. I went out on a leap of faith and ended up in California. His friend was a newleywed of all things and they had a one bedroom apartment which the 4 of us shared for about 6 months before things got really weird. They kicked us out because they said the landlord was threatening to evict them because there were too many people living in the apartment. Ok, understandable, but neither of us had jobs (my father was sending money and I was giving it to them to help out with the bills while we looked for jobs) and so now we were homeless...We slept under bridges together and slummed until finally we had to go to a shelter. While at the shelter, I was informed that I was approved for unemployment, so me and him stayed in a motel while we looked for work. I saved enough and bought him a car, and bought myself a car as well. He found work as a car sales man and I got temp work. We got into an apartment, on the money that I saved. So lets recap...I have been homeless with him, bought a car for him, put him up in two apartments so far, and now he has lost his job. There is no money coming in and I have landed my dream job. I bought a new car and am about to get myself out of the debt hole, but he is not bringing in any money and he just got approved for unemployment. I am just tired of carrying him. I want to leave him, but do not want to kick a man while he is down? The lease is in both of our names, and at this point, I just want to move out and get another apartment and move on with my life. Rather than researching the Dole you would be better looking into housing. Approach your local council and ask what options are available to you. If you remain in full-time eduction you should be able to get your rent and council tax paid for you in Council property but the risk being they may put you in a hostel or something of the like. If you are looking at private renting then you would be entitled to Local housing allowance, which is the same sort of thing as housing benefit along with council tax. As for income based benefits I am unsure whether you would need to claim income support, which I suspect you are looking at, or Jobseekers allowance. Again I would go down to your local council and ask, or phone for an appointment. They are generally very helpful with people in your situation.

You've got a tough situation here. To begin with, you dad will believe whatever he wants to believe (we're all that way, incidentally). He will have to see for himself what the situation is with his new wife. I would bet he already has suspicions. He probably still misses your mother and wants to have someone around who makes him feel better. I doubt that Miranda is really making him feel better. So try to have a talk with your father. Point out that you need his support and help in your life. That he is and always will be your father. That you anticipate someday he will walk you down the aisle when you're ready to get married. If he says he would want to bring Miranda then point out that if he does you would want to bring your boyfriend...but the real point of the trip is for you and dad to be together. Best friend lied and stole off me. What to do?

Extremely long story. I was at a party and I smoked weed and started hallucinating and losing it and wrecking the party. One of my good mates (guy who made the party) brought me up the stairs took me into a bedroom (looked after me for a while). There my best friend (of 5 yrs) apparently "stayed" in the room looking after me. Next morning, my $50 note was gone. I asked my best friend if he used it to buy Maccas for everyone, cause I remember people were eating Maccas. He said NO and started accusing my mate (the party starter) for taking the money and witnessed him having a $50 in his wallet and buying ciggies with it. I asked him if he drove my car to drop people off (he is on his L's and was drinking), he said NO. Found out my fuel was half gone and crums around the car. Next day one of my other mates admitted to using my car to drop people off and apologized sincerley. However my best friend still denied driving my car. Couple days later, we were chilling in my friends car (guy who made the party) and I asked him if he knew who stole my money. He said he knew and that it was a friend that stole my money and that he would never tell me because it will make things worse. My best friend who happened to be in the car, started to buckle and choke and started accusing my mate why he was getting the blame and that he was a dog c*nt for accusing him etc (in short it looked like he knew he did it and couldn't handle the pressure so he lashed out). I also found out from my mate (and several others) that my best friend took my car out for 3 Maccas runs, had a joy ride (with alcohol in his system) and LET a drunk 14 yr old with no license drive it (I was also told that the 14 yr old nearly crashed my car 4 times). My mate (party starter) also said things which were true - my best friend didnt bring money to the party, he witnessed my bestie holding a lot of cash (change from the $50 possibly?) and that he pretty much shouted everyone Maccas (my best friend is on the dole, lives on housing commission and suffers financially, he never shouts anything). I confronted my best friend after this argument calmly and with no swearing or voice raising, he responded by swearing and telling me off and how he looked after me all night and would never do such thing and that the money used for Maccas was from people chipping in. I also asked other party goers that night and one said that my best friend would do no such thing and that he chipped in small change for Maccas. However I talked with my mate (the party starter) and he was 100% certain he took the money and that 'looking after you all night' doesn't mean sh*t. What do I do in this situation? I feel my husband is cheating..what to do?

First of all I'd like to say what u all will be thinkin anyway...I am in a very weird and dysfunctional marriage. But I am a very religious person and I don't believe in divorce unless someone has committed adultery. Me and him got evicted and so we don't live together. Me and him fight all the time. What can I do about nuisance neighbors?

I live in a double and the neighbors upstairs are constantly fighting to the point where the cops are called. The woman has been "evicted" from the apartment (she isn't actually on the lease) by the police 3 times in the last 2 months, the locks have been changed several times, there is lots of yelling when she's here, stomping around, slamming doors and loud music. Within a couple weeks, the man up there will then drop the charges and have her move back in. The old tenant moved out because of this and we did not know until after we signed the lease. If anyone has any serious advice on what to do, I don't want the landlord to think I am a trouble maker if I call and complain, but we signed the lease before we knew any of this and there is no way I can pack up and move again at this point. I've already called him about the loud noise this week. The cops were here with her yesterday to pick up the last of her things, banging on the door, and then today she moved back in. Also, if it helps, I live in NY (not the city).

Ex-husband harassing me after our 31 y/o plead guilty to beating me up - what are my options?

Recently my 31 y/o son plead guilty to and is on probation in Virginia for domestic violence assault for beating me up in April of this year. In retaliation my ex-husband (divorced almost 24 acrimonious years) and my sister have been harassing my daughter (she does NOT live with me) to get possession of my son's belongings which he left in my house when he was arrested almost two months ago. Neither my son, his father nor my sister have approached me for access to my house. He has not paid rent since the police removed him from my property in handcuffs. My son gave his father power of attorney to enter my home which he had no right to do. My sister, a judge's secretary, sent an email and a fax with my ex-husband's demands to my employer's general email address and general fax number this morning which I don't have access to. My son is more than welcome to come get his belongings but his father and my sister are not welcome in my home at any time. What are my options to put an end to this drama? The father lives in CT and my sister is more than willing to facilitate whatever he wants as long as she feels important in doling out the harassment.

I really need to come up with $345 to pay off the rest of my rent which is due tomorrow and I never have a late payment. I'm in a really crappy situation right now. I'm on Ontario Works and normally get about $945 a month from them which is enough to cover my rent and have $200 to spend on anything else like groceries and diapers, etc. Anyway, I went back to work last month for only a month because I had to leave due to lack of funds for quality child care. Because of going back to work, Ontario works only gave me $400 and everything that I made from work had to go to groceries and child care so I had nothing left. I'm only 18 with little to no credit so I know it's hard to get a loan with all these circumstances but there has to be a way. If you know of any options please let me know, I don't need to be evicted before I can pay off the rent because that would be horrible. I normally pay my rent right on time and anything else right on time so after this slip up I could easily pay back the loan. Any advice would be great, thanks!

Landlord's agent trying to evict because of a personal favor?

my landlord received moneys from her agent who volunteered by offering to pay a months rent for me. now the following month she did it again without me knowing. when i tried to pay the rent she (agent) sent the money back to my house. so i called the landlord to set up a drop off directly to her. she tells me that the agent already paid her. now the agent filed for eviction. IS THIS LEGAL???

Use ankle weights you won't be very high when you use them at first, but if you use them for a while and then do a toe touch without and they should be higher! What Ever Happened to Tenant Rights?

Why does it seems like every year the change the law to take more rights away from tenants and give more power to landlords. I'm living in apartment where the Pool is broken and has No water, the place is filled with roaches, Parts of the stove dont work and some of the electrical outlets are broken. I cant afford to fix this stuff myself and i cant afford to just leave and find a new apartment like that, moving is a big expense. I asked the landlord to fix all this but they refuse saying they dont have the money and i'm inclined to beleave that because hardly anyone is renting apartments in the complex, theres only about 5 others beside myself and we are surrounded by empty apartments. I'm planning to refuse payment until they can fix everything or afford a new place but they said there just going to evict me if i dont pay. If i refuse to pay over these issues why is it they can still evict me? Reading the law in california it seems like landlords can get away with this, Is there anything i can do?
